This End User License Agreement ("EULA") is a binding legal agreement between you ("User") and skygpc governing your use of any scripts, configurations, or digital files (collectively, the "Software") provided by skygpc. By downloading, installing, accessing, or using the Software, you accept and agree to be bound by this EULA. If you do not agree, do not use the Software.
1. License Grant
Subject to your compliance with this EULA and our Terms of Service, skygpc grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one (1) copy of the Software on hardware you own or control, solely for your own personal, non-commercial use with the Cronus Zen device.
2. Ownership
The Software is licensed, not sold. skygpc and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted to you other than the limited license expressly set forth in this EULA.
3. Restrictions
You agree that you will not:
- Copy, reproduce, distribute, publish, transmit, modify, or create derivative works of the Software
- Sell, rent, lease, sublicense, lend, or otherwise transfer the Software to any third party
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
- Remove, alter, or obscure any proprietary notices on the Software
- Use the Software for any unlawful purpose, or in violation of any third-party terms of service
- Share your account credentials or download links with any other person
4. Nature of the Software
The Software consists of GPC scripts and hardware configuration files designed to run on the Cronus Zen controller adapter. The Software operates exclusively at the controller input layer and does not modify, inject into, or otherwise interact with any game software, game memory, game servers, or any digital-rights-management system.
5. Updates
skygpc may, at its sole discretion, provide updates, patches, or new versions of the Software. Any such updates are subject to this EULA unless accompanied by a separate license. skygpc is under no obligation to provide updates or to maintain compatibility with any particular game, console, or firmware version.
6. Termination
This EULA is effective until terminated. Your license will terminate automatically and without notice if you fail to comply with any provision of this EULA. Upon termination, you must immediately cease all use of the Software and destroy all copies in your possession. Sections 2, 3, 7, 8, and 9 survive any termination of this EULA.
7. Disclaimer of Warranties
The Software is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Software will be uninterrupted, error-free, or compatible with any specific game, console, or firmware version.
8. Limitation of Liability
To the maximum extent permitted by law, skygpc shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, profits, game accounts, or goodwill, arising out of or related to your use of the Software, even if skygpc has been advised of the possibility of such damages. skygpc's total cumulative liability under this EULA shall not exceed the amount you paid for the Software.
9. Governing Law
This EULA is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising under this EULA shall be resolved in accordance with the dispute resolution and arbitration provisions of our Terms of Service.
