DMCA Policy

skygpc respects the intellectual property rights of others and expects users of our services to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright or trademark infringement committed using our website that are reported to our designated agent identified below.

Reporting a Claim of Infringement

If you are a copyright owner or are authorized to act on behalf of one, and you believe content on skygpc infringes your copyright, please submit a written notice ("Notification") to our designated agent that includes substantially the following information required by 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, of the exclusive right that is allegedly infringed
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered
  • Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to allow us to locate the material (such as a URL)
  • Contact information for the complaining party — name, address, telephone number, and email address
  • A statement that the complaining party has a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the Notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Please note that under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly materially misrepresent that material is infringing.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent containing the following information per 17 U.S.C. § 512(g)(3):

  • Your physical or electronic signature
  • Identification of the material that has been removed and the location at which the material appeared before it was removed
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the complaining party

Upon receipt of a valid counter-notification, we may reinstate the removed material in 10 to 14 business days unless the original complaining party files a court action against you.

Repeat Infringer Policy

Consistent with 17 U.S.C. § 512(i), skygpc will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. We may also limit access to our services for any user who infringes any intellectual property rights of others, whether or not there is any repeat infringement.

If you believe that content on skygpc infringes your trademark rights, please contact us at legal@skygpc.com with substantially the same categories of information required for a DMCA Notification, plus identification of the trademark and a description of the alleged infringement.
